Holiday Compensation : Get What You’re Entitled To
Every once in a while you go on a holiday and are disappointed. The hotel just was not what you expected. The service was poor. You might expect the tour operator to offer you some money back on the hotel or perhaps give you some sort of a payment to make up for the unexpectedly unsatisfying trip. Surprisingly, this does not happen much, but there are reasons why companies do not reimburse dissatisfied travelers as you would hope that they would do. The economic climate is making tour operators and agents leery of giving back money to retain a client for future business. As things are, the money is more important. Also, many people are making their own arrangements and not depending on tour operators or travel agents. When a customer of a tour agency is dissatisfied, the agency can sometimes pressure, say, a hotel, to refund some of the money paid. They have some clout. A person who books their own accommodations is not often gifted with the same kind of clout.
That does not mean that you have to simply accept the situation though – far from it. The law is on your side if you have been mislead or mistreated and if you know what steps to take then you can certainly get some payback to make up for your poor holiday experience. - Don’t wait until you’ve gone home to complain. Speak up quickly so that the individual or company involved can take care of your complaint while you’re still on holiday.
- Find evidence. Write notes, take photos and videos. You should also call witnesses if necessary.
- Don’t make the complaint too elaborate. State your problem simply and succinctly.
- Keep your message simple and tell whoever you feel is at fault what the problem is.
- Be calm. If you stay calm you will appear to be the reasonable one, particularly in a court or mediation setting.
If you feel that the person with whom you have to deal is being unreasonable and is not willing to deal with your problem, it is within your rights to take them to court and seek legal action. A judge will not only decide if you have the right to compensation but will also decide how much compensation. If you follow the steps above, the chances are excellent that you will prevail in the end and walk away from your disappointing holiday with some money to spend on the next one.
